SPONSORED BY Preliminary Title Report: "Pre-Lim" By Nydia Lavine and Denny Lyons In the beginning of a purchase transaction, you will hear a great deal about the importance of the p-Iim report. First, is a pre-lim the same as title insurance? ABSOLUTLY NOT, a pre-lim is an offer to insure, it is not a report of a complete history of recorded documents relating to the proper- ty. A pre-lim is a statement of terms and conditions of the offer to issue a title insurance policy, not a representation as to the condition of title. These distinctions are important for the following reasons: First, no contract or liability exists until the title insurance policy is issued. Second, the title policy is issued to a specific insured person, and others cannot claim the benefit of the policy. Will the prelim disclose the complete condition of the title to a property? No. It is importmat to note that the pre-lim is not a written representation as to the condition of title and may not list all liens, defects, and encumbrances affecting title to the property, but merely reports the current ownership and mat- ters that the title company will exclude from coverage if an insurance policy should be issued. What role does a pre.lim play in the real estate process? Nydia Lavine and Denny Lyons A pre-lim contains the conditions under which the Title Company will issue a particular type of insurance poli- cy. The pre-lim lists, in advance of pur- chase, title defects, liens and encum- brances which would be excepted as well as any exclusions from coverage, if the requested policy were to be issued as of the date of the pre-lim. These exceptions and exclusions are meant to provide the parties and their agents with notice of matters that would not be covered under the terms of the policy and should be carefully considered. Thus, a pre-lim provides the opportu- nity to seek the removal of items refer- enced in the report, which are objection- able to the buyer prior to purchase. Carefully review the pre-lim. Should the title to the property be clouded, you and your agent will work with the seller and seller's agent to clear the unwanted liens and encumbrances prior to taking title.
